New Minnesota Statute

There is a new Minnesota statute that governs how HOAs maintain their properties. As a member of a Homeowners Association board, or management company, you should be aware of this new statute:

Minn. Stat. § 515B.3-107(b), requires HOA boards of directors to “prepare and approve a written preventative maintenance plan, maintenance schedule, and maintenance budget for the common elements.” It also requires HOA’s to follow it, and provide all owners in the HOA with a copy of the plan and schedule.

This statute applies to all HOAs established prior to August 1, 2017. It requires that the boards of directors comply with the requirements by January 1, 2019.
